1. Acceptance of Terms
By accessing or using Votem's website or services, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our services.
2. Services
Votem Corp provides election management software and services, including the CastIron® platform, to organizational clients. Our services are designed for use by organizations running member elections, including labor unions, credit unions, pension funds, and cooperatives.
3. Client Responsibilities
Clients are responsible for providing accurate voter eligibility lists, complying with applicable election laws and regulations, maintaining the confidentiality of administrator credentials, and notifying Votem of any election-specific requirements.
4. Compliance Guarantee
Votem's $50,000 compliance guarantee applies to elections conducted in full accordance with Votem's recommended procedures and client agreement terms. The guarantee covers fines resulting from election administration failures attributable to Votem's platform or services, subject to the terms of the client agreement.
5. Intellectual Property
The CastIron® platform, Votem website, and all related content are the intellectual property of Votem Corp. You may not copy, reproduce, or distribute any Votem content without written permission.
6. Limitation of Liability
To the maximum extent permitted by law, Votem's liability for any claim arising from these terms or our services is limited to the fees paid by the client in the three months preceding the claim.
7. Governing Law
These Terms of Service are governed by the laws of the State of Ohio, without regard to conflict of law principles. Any disputes shall be resolved in the courts of Cuyahoga County, Ohio.
8. Changes to Terms
We may update these Terms of Service from time to time. We will notify clients of material changes via email. Continued use of our services after changes constitutes acceptance of the updated terms.
